China pre-employment background checks: what may an employer verify?

A global screening package may include education, employment history, financial information and personal circumstances. A China employer should not order the entire package simply because headquarters uses it elsewhere. Start with the specific hiring requirement, then identify the minimum information and lawful route needed to verify it. A signed authorization is not permission to investigate everything about a candidate.

1. Connect each question to an actual job requirement

Article 8 of the PRC Labor Contract Law allows employers to understand basic circumstances directly related to the employment contract and requires applicants to answer truthfully. It does not create an unrestricted investigation power. For a role requiring a particular qualification, specify which qualification, why it is needed and how it will be checked. For employment history, distinguish verifying dates and responsibilities from collecting an entire former personnel file.

Articles 5–6 of the Personal Information Protection Law (PIPL) require lawful, legitimate and necessary processing, a clear and reasonable purpose and the minimum collection needed for it. Create a short matrix linking each check to the role, information fields, source and decision it supports. Remove speculative checks and unrelated family, financial or health details. Sector-specific eligibility or statutory screening duties require a separate check of their actual scope.

2. Identify the legal basis before asking for authorization

PIPL Article 13 includes consent, necessity for concluding or performing a contract with the individual, qualifying HR management and other specified bases. Its second paragraph removes the consent requirement for the statutory grounds in Article 13(1)(2)–(7). Document why the particular check fits the basis relied on. A prospective hire is not a reason to assume that every screening activity is necessary HR management; a global policy alone does not establish necessity.

Where relying on consent, Article 14 requires an informed, voluntary and explicit choice. Under Article 17, the notice should identify the processor and contact details, purpose, method, information types, retention period and rights procedure, subject to applicable statutory exceptions. Explain any proposed reference contact in advance, especially contact with a current employer. Use a specific, understandable scope rather than a perpetual authorization for any source and any use. Consent cannot cure excessive collection or an unlawful question.

3. Separate sensitive information and prohibited recruitment questions

Medical information and financial-account information are among the sensitive categories in PIPL Article 28. Processing requires a specific purpose, sufficient necessity and strict safeguards. Articles 29–30 address separate consent and additional notice of necessity and effects on rights; read the consent rule together with Article 13 and any applicable special provisions. Do not include sensitive fields by default merely because a vendor can supply them. A role-specific need must be assessed, not asserted through a template.

Article 43 of the Law on the Protection of Women’s Rights and Interests prohibits specified recruitment practices unless the State provides otherwise. These include further enquiries or investigations into female applicants’ marriage and childbirth circumstances beyond basic personal information, pregnancy tests in entry medical examinations, and using marriage or childbirth restrictions or status as hiring conditions. Outsourcing these questions does not make them acceptable. Review the questionnaire and vendor instructions before any contact begins.

4. Check the source and the vendor’s role

A search result is not automatically a reliable or unrestricted source. PIPL Article 27 limits use of lawfully public information to a reasonable scope, subject to express refusal, and addresses consent where processing significantly affects individual rights. Check identity matches, dates, context and the original source; distinguish an allegation from a finding. A former employer must also have a lawful basis to disclose information. Do not ask a vendor to obtain private account access or a database leak.

If the vendor processes only on the employer’s instructions, Article 21 requires an entrustment agreement covering purpose, duration, methods, information types, safeguards and responsibilities, with supervision and controls on subcontracting and return or deletion. An independent recipient may instead engage Article 23, including its notice and separate-consent rules read with Article 13. Review the applicable Article 55 impact-assessment requirements and any available lawful simplification before processing. Overseas vendor or headquarters access needs a separate transfer review before access is enabled.

5. Investigate discrepancies before making the decision

PIPL Articles 8 and 46 address information quality and correction. Give the candidate a practical opportunity to explain a discrepancy, then verify material points against the original source. Record why the confirmed fact matters to a lawful hiring condition. A vendor’s red flag is not itself proof of fraud. If work has begun, Articles 26(1)(1) and 39(5) of the Labor Contract Law require assessment of fraud causing the contract to be concluded against the employer’s true intention and invalidity, rather than treating every CV error as an automatic dismissal ground. Disputed invalidity is determined by the arbitration body or court.

Prepare the role requirements, check matrix, notices, basis or consent records, vendor agreement, source evidence, candidate explanations and proposed decision. Restrict report access and set retention by purpose under PIPL Articles 19 and 47; do not keep every unsuccessful applicant’s full report indefinitely. Review any existing offer or signed contract before cancelling recruitment. For an initial consultation, send a non-confidential outline of the China entity, city, role and disputed finding, rather than the candidate’s full dossier. Lawyer consultations are in Chinese and English.
