China work injury: employer filing deadlines and first-response evidence

When a China employee is injured, waiting for overseas approval, discharge from hospital or a disability assessment can cause the employer to miss a filing deadline. The immediate task is to arrange treatment, identify separate reporting duties and open an evidence file. A work-injury recognition application, a safety-accident report and an insurance claim are different procedures.

1. Arrange treatment and check urgent reporting duties

Articles 4 and 30 of the Regulation on Work-Related Injury Insurance require timely treatment; in an emergency, first aid may be obtained at a nearby medical institution. Nominate a China contact to coordinate the employee, hospital, local management and HR. Preserve original medical records and payment receipts. Treatment should not wait for the company to settle whether it accepts that the injury is work-related.

For a production safety accident covered by the Regulation on the Reporting, Investigation and Handling of Production Safety Accidents, Article 9 requires people at the scene to report immediately to the person in charge of the unit. That person must report within 1 hour of receiving the report to the competent safety authorities at county level or above where the accident occurred; urgent direct reporting by people at the scene is also permitted. Check the applicable sector and local channels. This is not a rule that every personal injury uses the same reporting route, and the 30-day recognition application below is not permission to delay an accident report.

2. Calendar the employer’s 30-day application separately

Article 17 of the Work-Related Injury Insurance Regulation normally requires the employer to apply to the social insurance administrative authority in the relevant pooling area within 30 days of the accident injury, or the lawful diagnosis or appraisal of an occupational disease. A special extension requires that authority’s agreement. Record the triggering date, competent authority, filing owner and submission receipt; a pending headquarters review does not establish an extension. If the employer misses the prescribed period, qualifying work-injury benefit expenses arising during that period are borne by the employer.

If the employer does not apply as required, the employee, close relatives or trade union may apply within 1 year of the relevant accident or diagnosis/appraisal. That is not the employer’s ordinary filing window. Article 7 of the SPC Interpretation on Administrative Work-Injury Insurance Cases excludes delay not attributable to the employee or close relatives, including specified force-majeure, restriction-of-liberty, employer-caused, registration and labor-relationship arbitration or civil-litigation circumstances. A late case therefore needs a dated chronology and evidence, not an automatic conclusion that every claim has expired after 1 year.

3. Preserve facts before deciding whether to dispute recognition

Article 18 requires the application form, proof of the employment relationship (including a de facto relationship), and a medical diagnosis or occupational-disease diagnosis/appraisal document. Preserve the actual time, place and activity: shift records, assigned tasks, travel orders, access logs, relevant messages, original photographs or CCTV and separate witness accounts. Record uncertainty honestly. For a covered safety accident, Article 16 also protects the scene and evidence; necessary movement for rescue, preventing escalation or clearing traffic requires marks, a scene sketch and written records.

Under Article 19 and Article 17 of the Recognition Measures, an employer disputing an employee’s or close relative’s assertion of a work injury bears the burden of proof. Refusal to provide evidence does not stop the authority deciding on the available evidence. Do not equate an employee’s carelessness with a statutory exclusion; examine the applicable recognition ground, Article 16 exclusions and reliable supporting documents. Preserve unfavorable evidence as well as material supporting the company’s position.

Remote work needs actual assignment and causation evidence. Point 9 of MOHRSS Opinion (III), Ren She Bu Fa [2025] No. 62, recognizes that employer-arranged work at home can qualify where sufficient evidence shows an accident injury genuinely arose from work. Incidental, temporary simple communications through WeChat, telephone or email are not treated as a work-related cause under that provision. A sudden illness at home follows its separate work-time and work-post analysis and the relevant statutory conditions; merely finding a work message is insufficient.

4. Track submission, acceptance and the decision as distinct events

Under Article 8 of the Recognition Measures, the authority reviews submitted materials within 15 days. If they are incomplete, it must notify the applicant in writing of all required supplements at one time; the acceptance or non-acceptance decision follows within 15 days after complete supplements are received. Keep the receipt, supplement notice, response and acceptance document together. A saved draft, an internal incident form or a notice to a commercial insurer is not proof that the recognition application was received.

The normal recognition-decision period is 60 days from acceptance, with 15 days for accepted cases having clear facts and clear rights and obligations. Where a necessary judicial or administrative conclusion is outstanding, the decision period is suspended under the statutory rule. Do not promise a final result within 60 days of the accident. Review the delivered decision and its stated challenge route promptly. Work-injury recognition is also distinct from the later labor-capacity assessment where a stabilized injury leaves a disability affecting capacity.

5. Prepare the employer review file and keep payment issues separate

Build one file containing the China employing entity and location, accident and notification chronology, employment and assignment records, medical documents, evidence-preservation record, insurance registration and payment records, payroll, and every official filing receipt or notice. Do not assume commercial accident cover replaces statutory work-injury insurance. Article 62 requires an employer that should have participated but did not to pay the prescribed work-injury benefits when a work injury occurs; who pays which item requires a separate coverage and local-rules review.

For treatment requiring a work-related suspension, Article 33 preserves original wages and benefits during the applicable paid work-suspension period, payable monthly by the employer. Do not automatically switch to ordinary sick-leave pay or assume the fund pays every expense. For initial legal review, share a non-confidential outline of the entity, city, accident date, filing status and nearest deadline. Arrange secure review of medical and personnel records afterwards, so counsel can prioritize the filing route, evidence gaps and payment responsibilities.
