1. Classify the original message before refusing the request
Article 37 of the PRC Labor Contract Law provides for 30 days’ prior written notice, or 3 days’ prior notice during probation. An unequivocal resignation under this route does not require employer approval. An internal form labelled “application” is not conclusive: read its wording, stated end date and surrounding communications. A proposal to leave only if a payment or other condition is agreed may instead require analysis as a negotiated exit under Article 36.
Do not treat allegations of coercion, forgery or lack of genuine intention as a routine change of mind. Preserve the interview record and complete messages, and obtain the employee’s explanation. A signed document is evidence, not a substitute for reviewing a credible challenge. An exit alleging employer breaches under Article 38 also needs its own assessment; this article addresses ordinary voluntary resignation.
2. Compare receipt times, not the last approval click
Civil Code Article 141 allows withdrawal of a declaration of intent if the withdrawal reaches the recipient before or at the same time as the original declaration. Article 137 addresses when declarations, including electronic messages, take effect: designated receiving systems, knowledge of arrival and any applicable agreement can matter. Preserve server timestamps, the receiving account, the recipient’s role and the full sequence; an email send time alone does not establish arrival.
For a clear, genuine resignation that has already reached the employer, a later request ordinarily cannot cancel it unilaterally merely because the notice period has not expired or the internal workflow remains unfinished. Check timely withdrawal, employer agreement and any defect in intention separately. Court explanations support these distinctions, but they are not a substitute for examining the facts and applicable local adjudication practice.
3. Keep the notice date separate from the employment end date
An effective notice is not an instruction to stop pay immediately. In an ordinary advance-notice resignation, employment continues through the applicable notice period until the lawful end date. Articles 29 and 30 require performance of contractual duties and timely, full pay. Confirm attendance, duties, leave and the actual end date while the withdrawal request is being reviewed.
If the company wants an earlier departure, review and record that arrangement separately. Do not turn a pending resignation into an immediate employer dismissal by blocking work and issuing inconsistent termination wording. Likewise, continued attendance before the original end date is expected performance; by itself, it does not prove that the employer has accepted permanent retention.
4. Make retention or refusal a clear company decision
If the employer agrees to retention, obtain a written mutual confirmation identifying the original notice and stating that it will no longer be acted on and employment continues. Record whether existing terms remain or separately document agreed changes under Article 35. Align the China employing entity, authorized signatory, line manager, payroll and IT. Do not manufacture a break in service simply to reset benefits or probation.
If refusing, respond promptly and factually after review: identify the original notice, receipt evidence, unchanged end date and remaining work arrangements. Avoid adding an unsupported misconduct finding. Reconcile any manager’s promise to keep the employee or work scheduled beyond the end date. The Shanghai First Intermediate People’s Court explains that agreement to continue may also arise from actual performance; a formal refusal can conflict with what the company subsequently does.
5. Prepare a decision file and finish the correct process
Prepare the original resignation and withdrawal messages, delivery records, contract and probation dates, all retention discussions, approval authority and work/pay records around the proposed end date. Include any settlement, promised payment or changes to duties. Recruitment progress is useful business context, but it does not cure an invalid resignation or decide the receipt chronology. Keep factual records separate from legal advice and restrict access to personnel material.
If employment lawfully ends, apply Article 50: issue the departure certificate at termination, arrange the required personnel-file and social-insurance transfers within 15 days, and retain the ended contract for at least 2 years. Deal with handover and final payments on their own basis. If employment continues, cancel pending exit instructions and verify that payroll, insurance and access records reflect the agreed outcome. Where intention, authority or the end date is disputed, obtain advice before implementing an irreversible exit step.
